IRS Errors and how to deal with them

Check out these before and after letters. A client of mine had been expecting a refund from his 2018 tax return, paper filed by his former accountant who had unfortunately passed away.


Unexplainably, although the taxpayer's wages were only about $40,000, married filing jointly, with numerous child dependents, the IRS was sending him letters about tax owed, culminating in a scary Intent to Levy letter. He didn't owe any tax for previous years, either.


Due to some sort of IRS processing error, these letters had been generated, causing years of delays and frustration.


The IRS had been impossible to get through to on the phone when he received the Intent to Levy letter. So, I wrote up a detailed letter explaining why these letters were erroneous, and why he deserved a refund after all.


Finally, after many months of waiting, the IRS agreed to make the changes, and issue the refund.


Yes, the IRS does make errors.


Good tip to keep in mind: If you can't get through to the IRS, write up a detailed letter, be VERY patient, and after 3-12 months hopefully your issue will be looked into.


Mailing a letter may be better than driving yourself crazy waiting on the phone for hours, only to be cut off due to an overload of the system in the middle of a call with a helpful agent who had finally gotten on the line!
