A US citizen can file a tax return jointly with their non-US citizen, non-US resident spouse

Updated: Dec 10

Did you know that a US citizen can file a tax return jointly with their non-US citizen, non-US resident spouse?

The non-US citizen spouse has to sign a special election, agreeing to be taxed as a US resident. This allows them to file jointly with their spouse. While they now do have US tax responsibilities, this turns out to be a great option to be able to qualify for the Child Tax Credit, and can be a great opportunity to qualify for refunds the couple otherwise would not have been able to receive.

Of course, the detriments of being taxed as a US citizen have to be weighed against the benefits, but for many people, it comes out well worthwhile.
